Welcome to Gaika's Goodies. These Terms of Service ("Terms") govern your use of gaikasgoodies.store (the "Site") and your purchase of products from us. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site or purchase from us.

Gaika's Goodies is a small, owner-operated business based in Texas, United States, selling handmade stationery products.

1. Eligibility

By using the Site, you represent that you are at least 18 years of age, or that you are using the Site under the supervision of a parent or legal guardian. The Site is not directed to children under 13.

2. Products

All products sold on the Site are handmade. Because each item is made by hand, individual products may vary slightly in color, pattern, texture, size, or other characteristics from the photographs shown on the Site. Such variations are a natural feature of handmade goods and are not defects.

We make reasonable efforts to display product colors and details accurately, but we cannot guarantee that your device's display will accurately reflect the actual product.

We reserve the right to limit quantities, discontinue products, or modify product designs at any time without notice.

3. Orders and Payment

By placing an order, you make an offer to purchase the selected products. We reserve the right to accept or decline any order for any reason, including suspected fraud, errors in pricing or product information, or product unavailability. If we cancel an order after payment, we will issue a refund for the canceled items.

All prices are listed in U.S. dollars and are subject to change without notice. The price charged is the price displayed at the time of checkout. Applicable sales taxes and shipping charges are added at checkout.

Payments are processed securely through Shopify and its payment providers. We do not receive or store your full credit or debit card number. You represent that you are authorized to use the payment method you provide.

In the event of an obvious pricing or listing error, we reserve the right to cancel the affected order and refund your payment.

4. Shipping and Delivery

We ship orders primarily through the United States Postal Service (USPS); other carriers may be used when needed. Estimated processing and delivery times shown on the Site are estimates only and are not guaranteed.

Risk of loss and title for products pass to you upon our delivery of the products to the shipping carrier. However, if your order arrives damaged or does not arrive, please contact us as described in Section 5 and we will work with you to resolve the issue.

You are responsible for providing a complete and accurate shipping address. We are not responsible for orders delivered to an incorrect address provided by you, though we will make reasonable efforts to help resolve such situations.

5. Returns, Refunds, and Order Problems

All sales are final. Because our products are handmade in small quantities, we do not accept ordinary returns or exchanges for change of mind, except where required by law.

However, we stand behind our products. Please contact us at gaika@gaikasgoodies.store within 14 days of delivery if:

• Your order arrived damaged;
• You received an incorrect item;
• Your order is missing or was not delivered.

Please include your order number and, for damaged or incorrect items, photographs of the item and packaging. We will review the issue and, at our discretion, offer a replacement, a refund, or another appropriate resolution.

Nothing in these Terms limits any rights you may have under applicable consumer protection law.

6. Promotions and Discount Codes

We may offer discount codes or promotions from time to time. Promotions cannot be combined unless expressly stated, have no cash value, and may be modified or discontinued at any time. Discount codes cannot be applied retroactively to prior orders.

7. Intellectual Property

All content on the Site — including product designs, photographs, text, graphics, logos, and the Gaika's Goodies name — is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, sell, or create derivative works from our content or product designs without our prior written permission. Purchasing a product gives you ownership of that physical item only; it does not transfer any intellectual property rights.

8. Acceptable Use

You agree not to use the Site:

• For any unlawful purpose;
• To place fraudulent orders or use unauthorized payment methods;
• To interfere with the operation or security of the Site;
• To scrape, harvest, or collect information from the Site by automated means;
• To infringe our intellectual property or the rights of others.

We reserve the right to refuse service, cancel orders, or restrict access to the Site for violations of these Terms.

9. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GAIKA'S GOODIES AND ITS OWNER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR ANY PRODUCT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the limitation of liability for certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Gaika's Goodies and its owner from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Site.

12. Third-Party Services and Links

The Site is hosted on Shopify, and payments, shipping, and other functions are provided by third-party services. We are not responsible for the acts, omissions, or policies of third-party providers. Any links to third-party websites are provided for convenience only, and we do not endorse or assume responsibility for their content.

13. Privacy

14. Governing Law and Disputes

These Terms and any dispute arising out of or relating to them, the Site, or your purchase of products shall be governed by the laws of the State of Texas, without regard to its conflict-of-law principles.

Before filing any formal claim, you agree to first contact us at gaika@gaikasgoodies.store and give us a good-faith opportunity to resolve the dispute informally within 30 days.

Any dispute that cannot be resolved informally shall be brought exclusively in the state or federal courts located in Texas, and you consent to the jurisdiction of those courts. Nothing in this section prevents either party from bringing a qualifying claim in small claims court.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

16. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Your continued use of the Site or purchase of products after changes are posted constitutes your acceptance of the updated Terms.
